These Terms of Service are effective June 15, 2022
If you are a federal government or federal government agency in the United States (“You” or “Your”), and You are using the Services in your official capacity (“Official Use“), the following addendum applies solely to such use and the Public Official Terms of Service (“Public Official Terms”) remain in effect to the extent they do not conflict with this Addendum. Any capitalized terms not defined herein shall have the meaning set forth in the Public Official Terms. In the event of a conflict between this addendum and the Public Official Terms, this addendum will control.
You and CivicBell will endeavor to resolve any disputes in an amicable fashion. To the extent arbitration is prohibited by applicable federal law, Public Official Terms related to binding arbitration do not apply to Your Official Use.
Public Official Terms relating to indemnification do not apply to Your Official Use except to the extent expressly authorized by federal law.
Your liability, to the extent there is any, shall be governed by the provisions of the Federal Tort Claims Act [28 U.S.C. 2671-80 (1976)].
If You have an official website, Your Public Official Page must contain, in a prominent location: “If you are looking for more information about [Government Entity], please visit [website URL].”
CivicBell will not use your name, seals, trademarks, service marks, trade names, and the fact that You have a presence on CivicBell or use other CivicBell Services, to state or imply an endorsement of CivicBell Services. However, to the extent allowable by applicable federal law, CivicBell may use your seals, trademarks, services marks, trade names, and the fact that You have a presence on CivicBell or use other CivicBell Services, as necessary for CivicBell’s regular operation of its Services, not to include commercial or marketing or other services which could imply endorsement by You of CivicBell.
This Addendum and any action related thereto will be governed by applicable federal law (without reference to conflict of laws).
This Addendum and the Public Official Terms of Service shall be publicly available.
Nothing in this Addendum shall obligate You to any current or future expenditure of resources in advance of the availability of appropriations from Congress.
